Which companies are required to comply with the COVID-19 Vaccination and Testing Emergency Temporary Standard (ETS)?
All employers with 100 or more employees, that are under OSHA’s authority and jurisdiction are required to comply.
Are employees who work from home required to be tested?
No. Employees who work from home, or work exclusively outdoors are not required to be tested.
How often must employees be tested?
Vaccinated employees do not need to be tested. Unvaccinated employees must be tested weekly (every 7 days) or within 7 days of returning to work if away from the workplace for longer than a week.
Do employers have to report COVID-19 hospitalizations and fatalities to OSHA?
Yes. The ETS requires employers to report work-related COVID-19 fatalities to OSHA within 8 hours of learning about them, and work-related COVID-19 in-patient hospitalizations within 24 hours.
Do employers have to maintain testing and vaccination records?
Yes. The ETS requires employers to keep records of each employee’s COVID-19 vaccine documentation, and any COVID-19 test results. The ETS also requires employers to make these records available for examination and copying to employees and anyone having written authorized consent of the employee. Employers must also make available the aggregate number of fully vaccinated employees at a workplace along with the total number of employees at that workplace.
Does STAT Research provide testing results?
Yes. Your company will receive a unique company portal where you can manage your employees’ vaccination status, your workplace vaccination rate, and your employees’ individual testing results. You, as the employer, will still need to maintain proof of vaccination for your vaccinated employees.
